Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the www.namocasa.com website (the “Service”) operated by Namo Casa (“us”, “we”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Products & Nature of Stone
You acknowledge that natural stone (Marble, Granite, Quartzite, Limestone, Onyx) is a product of nature.
Variations: Variations in color, pattern, texture, and veining are inherent and are not considered defects.
Samples: Samples provided are for general reference only. The actual product delivered may differ slightly from the sample or photos.
Customization: All cut-to-size and fabricated products are made to your specific project requirements.
2. Sourcing Agent Services
When Namo Casa acts as a Sourcing Agent for third-party products (e.g., Ceramics, Hardware, Furniture):
We act as an intermediary to facilitate the purchase and logistics.
While we perform quality inspections (QC), the ultimate warranty lies with the original manufacturer of the goods.
Our service fee covers sourcing, negotiation, QC, and consolidation, but does not cover import duties or taxes in your country unless DDP terms are agreed upon.
3. Orders & Payment Terms
Quotation Validity: Quotes are valid for 15 days due to currency and material cost fluctuations.
Deposit: A non-refundable deposit (typically 30%-50%) is required to initiate production or sourcing.
Balance: The remaining balance must be paid prior to shipment release (Bill of Lading release) or as per the specific Proforma Invoice terms.
4. Shipping & Delivery
Incoterms: Unless otherwise specified, standard shipping terms are FOB (Free on Board) China Port. Risk of loss passes to the buyer once goods are loaded onto the vessel.
Delays: Namo Casa is not liable for delays caused by shipping lines, customs clearance, port congestion, or force majeure events.
5. Intellectual Property
The Service and its original content, features, and functionality (including all stone photos, project gallery images, and branding) are and will remain the exclusive property of Namo Casa. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Namo Casa.
6. Returns & No Refund Policy (Crucial)
Strict No-Refund Policy on Custom Orders:
Due to the bespoke nature of our products and the high costs of international logistics, all sales are final once production has commenced.
Customization: Products cut to specific dimensions or fabricated for your project cannot be resold and therefore cannot be returned.
Pre-Shipment Approval: We commit to sending detailed photos and videos of the finished product for your approval prior to packaging. Your approval or payment of the balance constitutes acceptance of the product quality.
Damages & Claims: In the rare event of breakage during transit, you must notify us within 48 hours of receipt with photographic evidence. We will assist in filing insurance claims or arranging replacements for future shipments. We do not offer cash refunds for transport damage.
7. Force Majeure (不可抗力)
Namo Casa shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.
8. Limitation of Liability (责任限制)
In no event shall Namo Casa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service or products.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of China (or Hong Kong SAR), without regard to its conflict of law provisions.
